Expenses, including attorney’s fees, incurred in defending a civil or criminal proceeding may be paid by the city in advance of the final disposition of such proceeding as authorized in the manner provided in MCC 2.25.080 upon receipt of an undertaking by or on behalf of the officer, employee or councilmember to repay such amount unless it shall ultimately be determined that he is entitled to be indemnified by the city as authorized by this chapter.
