A. Restrictions on Storage and Display. No person who owns, conducts, operates or manages a business where tobacco products are sold, nor any person who sells or offers for sale tobacco products, shall store or display, or cause to be stored or displayed, such tobacco products in an area or manner that is accessible to the public without employee assistance.

B. Exemptions. A person is exempt from the requirements of this section if both:

1. The business where tobacco products are sold prohibits entry of individuals under the age of 18 at all times; and

2. Photographic identification is required from any individual who appears to be 26 years of age or younger prior to entering the business where tobacco products are sold.

C. Violations and Penalties. Violations of this section are considered a civil offense, subject to a fine of one hundred dollars ($100.00) for the first offense and five hundred dollars ($500.00) for each subsequent offense. [Ord. 10-03 § 1; Res. 10-13 § 1; Code 2004 § 10-3-2.]
